PRIVACY POLICY FOR RECRUITMENT

Company Wultra s.r.o., ID no.: 03643174, registered office at Bělehradská 858/23, Vinohrady, 120 00 Praha 2, registered in the Commercial Register administered by the Municipal Court in Prague, section C, insert 235343 (hereinafter as “Wultra”) hereby informs applicants for a job and applicants interested in other cooperation with Wultra (hereinafter jointly as “Candidates”) about processing of their personal data in the context of Wultra’s recruitment process.

The document includes information about the rights the Candidates have in connection with the personal data processing.

1. PURPOSES, LEGAL GROUNDS AND CATEGORIES OF PERSONAL DATA PROCESSED

1.1. Applying for employment or other cooperation with Wultra

Wultra will process your personal data necessary to assess whether you are a suitable Candidate for the offered work position or cooperation. This process includes especially receiving and evaluating CVs and cover letters, conducting interviews and, where appropriate, tests, preparation of the necessary contractual documents, communication with the Candidate, etc. For these purposes, the following personal data is typically processed:

  • identification data of the Candidate (name, surname, title, date of birth),
  • contact details (e-mail, telephone, LinkedIn profile),
  • information about Candidate’s education, work experience, knowledge, skills and qualifications for the position or cooperation offered, references,
  • any other information theCandidate provides in their CV, cover letter, during interviews or tests,
  • information from communication with the Candidate in relation with the recruitment process.

Without the above data, Wultra may not be able to properly evaluate the suitability of the Candidate for the employment or other cooperation. Legal grounds for processing the above data:

  • taking steps at the request of the Candidate prior to entering into contract.

1.2. Compliance with Wultra’s legal obligations

In some cases, Wultra is required by law to process personal data of the Candidates. If the Candidate applies for permanent employment, Wultra is obliged to process information on whether or not the Candidate is medically fit for the work. For this purpose, the following personal data is processed:

  • information in medical examination report issued by occupational health service provider; such report only states whether the Candidate is or is not fit for the given work and Wultra does not process any specific health information about the Candidate.

Legal grounds for processing the above data:

  • compliance with legal obligations of Wultra, especially as set out by Act No. 262/2006 Sb., the LaborCode, as amended (hereinafter as “Labor Code”).

1.3. Protection of Wultra’s claims

In order to be able to defend Wultra’s rights and claims in any legal disputes or legal proceedings (in particular to prove, if necessary, that Wultra has acted in accordance with its contractual and legal obligations), Wultra may, in justified cases, process Candidate’s personal data, which includes especially:

  • identification and contact data of the Candidate,
  • information necessary to assess the (un)suitability of the Candidate for the given position or cooperation, and
  • information from mutual communication in connection with the recruitment process.

Legal grounds for processing the above data:

  • legitimate interests pursued by Wultra (protection of Wultra’s rights and claims, defense against claims of others).

1.4. Database of candidates

With the Candidate’s consent, Wultra may list the Candidate in Wultra’s internal database of Candidates who either expressed their interest in working with Wultra without any specific position opening or did not succeed in the recruitment process fora specific position, and who wish to be contacted if a suitable position is opened in the future. Wultra may contact the Candidate listed in its database and offer them to participate in future recruitment procedures. For this purpose, the following personal data will be processed:

  • identification data of the Candidate (name, surname, title),
  • contact details (e-mail, telephone),
  • any other information theCandidate provides in their CV and cover letter sent to Wultra,
  • in cases of Candidates who did not succeed in previous recruitment procedure, also information provided by the Candidate in the original recruitment procedure (in particular information from communication with the candidate, records from interview, reasons for rejection of the Candidate etc.).

Legal grounds for processing the data:

  • consent of the data subject (Candidate).

The consent may be granted by consenting via e-mail or other communication channels, or by submitting your CV and other details without any specific work position opening via web form in the career section on Wultra’s website.

The consent is voluntary. If you choose not to grant the consent, it will not affect your result in any of Wultra’s recruitment procedures.

The consent is granted for 5 (five) years. You can choose to withdraw the consent sooner. The consent may be withdrawn any time for free via contact e-mail stated above in this document.  

If you choose to withdraw your consent, or once the duration of the consent terminates, Wultra will delete you from the database of the Candidates and will cease the processing of your personal data for this purpose. Some personal data may be processed longer based on other legal grounds, as specified in this document.

2. WHERE DO WE GET THE PERSONAL DATA FROM AND WHO DO WE HAND THEM TO?

Wultra collects personal data of the Candidates primarily from the Candidates. The Candidates are obliged to provide true and correct information and in case of any changes of their personal data during the recruitment process, the Candidates are kindly asked to notify Wultra.

Wultra may also collect personal data of the Candidates from recruitment agencies, specifically from:

  • StartupJobs.com s.r.o., Šostakovičovo náměstí 1515/5, 155 00 Praha 5 – Stodůlky, Czech Republic (operator of internet portal startupjobs.cz),
  • Alma Career Czechia s.r.o., Menclova 2538/2, Libeň, 180 00 Praha 8, Czech Republic (operator of internet portal jobs.cz),
  • GoodCall s.r.o., Václavské náměstí 846/1, Nové Město, 110 00 Praha 1, Czech Republic,
  • Talentinno s.r.o., Ovocný trh 568/17, 110 00 Praha 1, Czech Republic.

In some cases, we may also obtain data from the Czech Employment Office.

For certain positions and types of cooperation (where appropriate and necessary), Wultra may carry out a background check based on publicly available information and references from previous employers to verify the suitability and credibility of the Candidate.

Wultra’s employees or other coworkers have access to the personal data of the Candidates. However, Wultra makes sure that access to personal data is granted on a need-to-know basis, all employees and coworkers always process the personal data only as necessary to fulfil the purposes above and are all bound by the obligation to maintain confidentiality about the personal data as well as security measures the disclosure of which could compromise the security of personal data.

Wultra uses the following data processors to process your personal data for Wultra and based on Wultra’s instructions:

  • IT service providers (including cloud infrastructure and operators of software used by Wultra, operator of website platform),
  • Wultra’s contractors involved in the recruitment process.

Personal data of the Candidates may be transferred to a third country (outside of the EU) in connection with transfer of the data to our data processors who are settled in third countries. Personal data is only transferred to a third country if conditions set out by law for such a transfer are fulfilled (e.g. appropriate safeguards are in place, typically the Standard Contractual Clauses approved by the Commission of the EU are concluded, or the transfer is based on an adequacy decision issued by the Commission of the EU).

Furthermore, Wultra may hand personal data of the Candidates to state and other public authorities for the purposes of exercising their legal duties and competencies, if required by law or by a decision or act of the competent state or other public authority.

3. HOW LONG DO WE PROCESS the PERSONAL DATA?

Wultra processes your personal data for the duration of the recruitment procedure in which you participate, this is typically for 1 month from its start.

In case the Candidate is successful and Wultra offers them employment or other cooperation, Wultra will continue to process the personal data of the Candidate (such as the Candidate’s identification and contact data, CV, other data and records from the recruitment procedure, data from communication with the Candidate etc.) in relation to conclusion and performance of the employment relationship or other cooperation. More detailed information about such processing is described in Wultra’s Privacy Policies for Employees and for Contractors, which will be provided to the Candidate before entering into the relevant contract with Wultra.

In case the Candidate is not selected or is not contacted by Wultra (typically within 2 (two) weeks from the initial contact), Wultra will cease the processing of the Candidate’s personal data within 1 (one) month from the end of the recruitment process in which the Candidate participated. If the Candidate wishes to be listed in Wultra’s database of Candidates as described in paragraph 1.4 of this document, Wultra will process their personal data based on their consent for the duration of the consent or until the consent is withdrawn.

Some personal data may be processed by Wultra even longer than described above. This is to protect the legitimate interests of Wultra as described in Article 1.3 of this document. In these cases, the duration of the personal data processing depends on the periods of limitation of Wultra’s or the Candidate’s claims, which in the Czech Republic may be up to 15 years from the occurrence of the relevant event.

4. What rights do you have in relation to personal data processing?

If you wish to exercise any of the rights, please contact Wultra via the e-mail provided above in this document.

Right of access: You have a right to obtain confirmation as to whether Wultra processes your personal data, and if so, you have the right to access that data, including the right to obtain a copy of the data. Further, you may request information about the details of the data processing, especially about:

  • the purposes of processing,
  • personal data or, where applicable, categories of personal data subject to processing, including any available information about their source,
  • the nature of the automated decision-making, including profiling and information relating to the procedure used, as well as the relevance and expected consequences of such processing for the data subject, if such processing takes place,
  • recipients of your personal data and, where appropriate, categories of these recipients,
  • the planned period during which the personal data will be stored or, if it cannot be determined, the criteria used to determine that period,
  • all available information about the source of personal data unless the data is collected from you,
  • information whether the personal data are transferred to a third country and if so, also information about appropriate safeguards relating to the transfer.

Your other rights:

  • to ask us for an explanation regarding the processing;
  • to request rectification, i.e. correction of inaccurate or incomplete personal data;
  • right to erasure (to be forgotten) – in certain cases, you may request us to delete your personal information (for example, if the data is no longer necessary for the purposes for which it was collected);
  • right to restriction of processing - you have the right to ask us to limit how we can use your personal data (for example if your data is inaccurate or the processing is unlawful);
  • right to data portability – to request personal data relating to you in a structured, commonly used, and machine-readable format and transfer this data to another controller without hindering it in any way;
  • to object to the processing of your personal data in case the data is processed (i) to perform at ask carried out in public interest or in the exercise of official authority vested in the controller, (ii) for legitimate interests pursued by the controller or by a third party, or for purposes of direct marketing;
  • to withdraw consent to processing – if your personal data is processed on the basis of your consent, you can withdraw your consent to the data processing at any time freely and free of charge;
  • to submit a question orcomplaint to the Office for Personal DataProtection (Úřad pro ochranu osobních údajů), website: www.uoou.cz.
